OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: In the south parking lot of JCPenny in The Treasure Coast Mall in Jensen Beach, Florida: Employees performing landscape work using an 8 ft. fiberglass step ladder to dump refuse cans into the back of a truck were exposed to the hazard of falling from that ladder while not used in the fully open position, on or about October 17, 2012. Among other means, one feasible means of abatement is to ensure step ladders are used for the purpose which they are designed and use only when in its fully-opened position, as required by the American National Standards Institute ANSI A14.5 for Ladders-Portable Reinforced Plastic.
