At the work site, wipe samples were positive for lead where employees worked on the firing range, at various sales counters and in other areas of the store that included (but were not limited to) break areas, bathrooms, lounge, and refreshment area. The employer did not ensure that the work site was kept as free as possible from lead accumulation.

29 CFR 1910.1030(c)(1)(i): Each employer having an employee(s) with occupational exposure as defined by paragraph (b) of this section shall establish a written Exposure Control Plan designed to eliminate or minimize employee exposure. a. Employees who worked selling guns and hunting supplies to customers and cleaning the two indoor firing ranges, cleaned up blood and body fluids from a self-inflicted shooting on the handgun range, as directed by the employer. The employer did not have a written exposure control plan for employees with occupational exposure to blood and body fluids.

29 CFR 1910.1030(f)(1)(i): The employer shall make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure, and post-exposure evaluation and follow-up to all employees who have had an exposure incident. a. Employees of a sporting goods store were directed to clean up blood and body fluids after a customer committed suicide on the indoor firing range. The employer did not offer post exposure evaluation, hepatitis B vaccination, or medical follow-up to employees who were exposed to blood and body fluids during the clean-up.

29 CFR 1910.1030(g)(2)(i): The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program. a. Employees with occupational exposure to blood/body fluids were directed by the employer to clean up after a suicide on one of the ranges. The employees had not been trained by the employer on bloodborne pathogens.
