Top guardrail system member was not 42 inches plus or minus 3 inches, thereby exposing employee to fall hazard of approximately 25 feet to the ground. 29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) 347 MT. Hope Ave, Rockaway, NJ.      Employees were not trained to recognize hazards associated with scaffolds. Hazards that were observed with the employees working on tubular frame scaffold, which included, but were not limited to fall protection, and erection.                               Violation observed on or about 10/09/2012.        Kiev Star Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard which was contained in OSHA Inspection Number 311107510, Citation Number 1, Item 1B issued on 10/02/2007 and final order date of 09/14/2007 with respect to a workplace located at Trussville, AL.
