Tubular frame scaffold was not braced to prevent swaying and displacement, thereby exposing the employees working on scaffold to a possible collapse. 29 CFR 1926.451(g)(4)(ii): The top edge height on all supported scaffolds where both a guardrail and a personal fall arrest system were not between 36 inches (0.9 m) and 45 inches (1.2 m) above the platform surface:Note:  For supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required, the top edge height should be between 36 inches (0.9 m) and 45 inches (1.2 m). Top guardrail system member was not 42 inches plus or minus 3 inches, thereby exposing employee to fall hazard of approximately 25 feet to the ground. 29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) 347 MT. Hope Ave, Rockaway, NJ.      Employees were not trained to recognize hazards associated with scaffolds. Hazards that were observed with the employees working on tubular frame scaffold, which included, but were not limited to fall protection, and erection.                               Violation observed on or about 10/09/2012.        Kiev Star Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard which was contained in OSHA Inspection Number 311107510, Citation Number 1, Item 1B issued on 10/02/2007 and final order date of 09/14/2007 with respect to a workplace located at Trussville, AL.
