29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c):      The employer does not ensure that employees are protected from cave-ins while working in excavations. This violation was observed on or about October 17, 2012, when an employee was exposed to cave-in hazards while working in an excavation that was not sloped, benched or shored.   In accordance with the regulation     SER Construction Partners, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312923832, citation number 2 item number 1 and was affirmed as a final order on December 22, 2010, with respect to a workplace located at the corner of Castlewood Ave. & 518, Friendswood, TX 77546.    SER Construction Partners, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312923188, citation number 2 item number 1 and was affirmed as a final order on October 19, 2010, with respect to a workplace located at the corner of friendswood Drive & West Willow Wick, Friendswood, TX 77546.    SER Construction Partners, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312538424, citation number 1 item number 1 and was affirmed as a final order on February 24, 2009, with respect to a workplace located at the corner of Rodd Field Rd & Brooke, Corpus Christi, TX 78414.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all excavations that employees are required to work in are either sloped, benched, or shored on all sides of the of the excavation in accordance with 29 CFR 1926.652 paragraph (b) and/or (c) to prevent possible cave-ins.
