29 CFR 1926.52(d)(1): In all cases where the sound levels exceed the values shown in Table D-2, a continuing, effective hearing conservation program was not administered: a) On or about October 16, 2012, and times prior, the employer failed to protect the hearing of an employee exposed above 90 dBA as an 8-hour time weighted average (TWA) by developing and implementing a hearing conservation program. One employee was monitored and found to be exposed to 92.5 dBA TWA (146% dose) while operating a portable grinder over a period of 480 minutes. 29 CFR 1926.55(a): Employee(s) were exposed to materials(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists: a) On or about October 16, 2012 and times prior, an employee was exposed to respirable dust containing silica at an 8-hour time-weighted average (TWA) above the OSHA permissible exposure limit (PEL). This employee exposure was measured to be 37.03 million particles per cubic foot (mppcf), or approximately 2.7 times the PEL of 13.89 mppcf. Sampling was conducted for 396 minutes. The calculation assumed zero exposure for the unsampled portion of the shift. The employer had not adequately controlled the dust generated from the grinding of concrete in order to prepare joints for caulking. 29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) On or about October 16, 2012 and time prior, employees were exposed to illnesses in that, the employees were required to wear n-95 respirators prior to being fit tested.
