29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Construction Site: On or about October 17, 2012 and at times prior, employees working around scaffolding were exposed to over-head struck by hazards such as bricks and hand tools. Hard hats were not being worn. b) Construction Site: On or about October 17, 2012 and at times prior, as the controlling employer, Jones Construction did not ensure its sub-contractor, Magic City Masonry & Stucco, Inc., protected their employees in that employees were exposed to overhead and struck-by hazards. Employees working around scaffolding were exposed to over-head struck by hazards such as bricks and hand tools. Hard hats were not being worn.

29 CFR 1926.451(f)(12): Work on or from scaffolds was not prohibited during storms or high winds unless a competent person has determined that it is safe for employees to be on the scaffold and those employees are protected by a personal fall arrest system or wind screens: a) Construction Site: On or about October 17, 2012 and at times prior, as the controlling employer, Jones Construction did not ensure its sub-contractor, Magic City Masonry & Stucco, Inc., protected their employees in that employees were exposed to a fall of approximately 18 feet to the ground below while working on a scaffold during high winds with no personal fall arrest system or wind screens.
