29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: -On or about October 17, 2012 and days prior, employees performed work on the roof and left the roof hatch open exposing themselves to a potential fall height in excess of 10' through the open hatch. No fall protection system was in use around the open hatch.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. -Employees were exposed to fall hazards in that they were performing work on the roof of a commercial structure while not utilizing any type of fall protection system.

29 CFR 1910.27(c)(4): "Clearance in back of ladder." The distance from the centerline of rungs, cleats, or steps to the nearest permanent object in back of the ladder shall be not less than 7 inches, except that when unavoidable obstructions are encountered, minimum clearances as shown in figure D-3 shall be provided. -The fixed ladder that is located in the maintenance room on the sixth floor of the structure, leading up to the roof, has an insufficient rung depth of 4-3/4" on the upper four rungs, exposing employees to a potential fall in excess of 7'.
