29 CFR 1910.1200(d)(2):     Chemical manufacturers, importers or employers evaluating chemicals shall identify and consider the available scientific evidence concerning such hazards. For health hazards, evidence which is statistically significant and which is based on at least one positive study conducted in accordance with established scientific principles is considered to be sufficient to establish a hazardous effect if the results of the study meet the definitions of health hazards in this section. Appendix A shall be consulted for the scope of health hazards covered, and Appendix B shall be consulted for the criteria to be followed with respect to the completeness of the evaluation, and the data to be reported.    The employer did not assess the health hazards associated with inhalation of the product Hule-Tide TPO Bonding Adhesive when they exposed employees at the 605 Vandalia Street, Collinsville, IL location to health hazards including headache, dizziness and anaphylaxis which resulted in emergency medical treatment.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      At 605 Vandalia St., Collinsville, IL, employees were exposed to inhalation hazards over a period of three days from the product Hule-Tide TPO bonding adhesive being used by a contractor hired by the employer for roof repairs at the site.  Employee exposure to the product produced central nervous system symptoms consistent with the chemicals comprising the product.

29 CFR 1910.1200(g)(1):     Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use.    The employer did not provide employees with a material safety data sheet for the roofing product Hule-Tide TPO Bonding Adhesive prior to having the roofing work done, and employees were exposed to inhalation hazards from the product during use.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    The employer failed to provide information and training to to employees on the hazards of the product Hule-Tide TPO Bonding Adhesive prior to the roofing work being performed at the worksite at 605 Vandalia St., Collinsville, IL.  Employees were exposed to inhalation hazards from the product.
