29 CFR 1910.178(l)(4)(iii):     An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    The employer is failing to protect employees from potential struck by hazards associated with failing to evaluate and recertify forklift operators every three years.  This was most recently evident during the inspection of the facility located at 5120 NW 38th Street, Lincoln, NE 68524, where the employer has employees operating propane powered forklifts used to move pallets of materials across the facility without having conducted an evaluation of each operators performance within the past three years.

29 CFR 1910.179(j)(2):     Frequent inspection. The following items shall be inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections. All deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard:    The employer is failing to protect employees from potential struck by hazards associated with using overhead gantry cranes on a daily basis without performing the required frequent inspections.  This was most recently evident during the inspection of the facility located at 5120 NW 38th Street, Lincoln, NE 68524, where the employer has employees using two 3 ton overhead gantry cranes to lift up to 1500 pound molds into place on the injection molding machines without conducting any frequent inspections.  Required checks under frequent inspections include but are not limited to:      i.  All functional operating mechanisms for maladjustment interfering with proper operation.  Daily.    ii.  Deterioration of leakage in lines, tanks, valves, drain pumps, and other parts of air or hydraulic systems.  Daily.    iii.  Hooks with deformation or cracks.  Visual inspection.  Daily.   Monthly inspection with a certification record which includes the date of inspection, the signature of the person who performed the inspection and the serial number or other identifier of the hook inspected.    iv.  Hoist chains, including end connections, for excessive wear twist distorted links interfering with proper function or stretch beyond manufactures recommendations.  Visual inspection.  Daily.  Monthly inspection with a certification record which includes the date of inspection, the signature of the person who performed the inspection and the identifier of the chain which was inspected.    v.  All functional operating mechanisms for excessive wear of components.    vi.  Rope reeving for noncompliance with manufacturers recommendations.

29 CFR 1910.253(b)(4)(iii):     Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.    The employer is failing to protect employees from potential explosion hazards associated with storing oxygen cylinders within 20 feet of fuel-gas cylinders and other potential spark or heat creating sources. This was most recently evident during the inspection of the maintenance room of the facility located at 5120 NW 38th Street, Lincoln, NE 68524, where the employer stores a full spare oxygen tank 12-18 near fuel gas cylinders and other potential spark or heat creating sources.  Instances include but are not limited to:    i.  Work table 12 away where maintenance employees welding and fabricate metal with grinders and other spark creating tools.    ii.  Acetylene tanks used for welding, one directly next to the oxygen tank the other 18 across the room.    iii.  Bench grinder 4 away creates sparks when grinding tools.
