29 CFR 1926.451(g)(1)(vii):     Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    a. At the SUSA construction site, 1676 Rowe Parkway, Poplar Bluff, MO, on 10-17-12, employees were working on a three tier scaffold (approximately 13'5") without any guardrails.    Abatement documentation is required for this violation.

29 CFR 1926.453(b)(2)(v):     A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift (Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system):    a. Employees were working, at the SUSA construction site, 1676 Rowe Parkway, Poplar Bluff, MO, from a front loader (CASE 686GXR) supported work platform without guardrails and fall protection harness.    Abatement documentation is required for this violation.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a. At the SUSA construction site, 1676 Rowe Parkway, Poplar Bluff, MO, on 10-17-12, where employees were working on a three tier scaffold without any guardrails and loader supported platform without guardrails and personal fall arrest harnesses, a training program was not established on safe erection and use of scaffold and of personal fall arrest systems (harness, lanyard, anchor point) (Note: training documentation is required).    Abatement documentation is required for this violation.

At the SUSA construction site, 1676 Rowe Parkway, Poplar Bluff, MO, on 10-17-12, employees were working on a three tier scaffold (approximately 13'5") without any guardrails; that scaffold was not fully planked (one pick board space was open without a plank).    Abatement documentation is required for this violation.

29 CFR 1926.451(c)(2)(iv):     Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:  Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.     a. Employees were working, at the SUSA construction site, 1676 Rowe Parkway, Poplar Bluff, MO, from a front loader (CASE 686GXR) supported work platform without guardrails and fall protection harness; the platform was not secured to the loader and was not engineered as a working platform (such as for capacity, anchor point for PFAS, etc.).    Abatement documentation is required for this violation.
