29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.          a)     At the worksite, the employer did not ensure that employees were protected from fall hazards associated with working from a pump jack scaffold platform, near and/or at the ends of the scaffold, at heights greater than ten feet, thereby exposing employees to an approximate 16 foot fall hazard.

29 CFR 1926.454(c)(3):     When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations:  Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency.          a)     At the site where siding work was being performed from a pump jack scaffold, the employer did not ensure that employees retained the knowledge to understand the use of fall protection and to utilize when required, such as, but not limited to all open sides of a pump scaffold shall be guarded, when working at heights greater than ten feet.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.          a)     At the worksite, the employer did not ensure that employees were protected from fall hazards while working at heights greater than six feet, performing siding and/or exterior trim task, thereby exposing employees to an approximate 22 foot fall hazard.      Gregorio Correa Montoya was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 314591736, Citation Number 1, Item Number 1 and was affirmed as a final order on March 31, 2011, with respect to a workplace located at 129 Holly Hock Lane, Lewis Center, OH 43035.
