29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    On or about October 23, 2012:    Employees were exposed to chemicals while making floc logs and other environmental products.  Chemical products used include, but are not limited to Dry Alum, Hydrated Lime, and Ben Franklin Agricultural Gypsum.  The employer had not developed a hazard communication program.

29 CFR 1910.1200(h)(1):     The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area    On or about October 23, 2012:    Employees were exposed to chemicals while making floc logs and other environmental products.  Chemical products used include, but are not limited to Dry Alum, Hydrated Lime, and Ben Franklin Agricultural Gypsum. The employer had not provided training to employees on the hazards specific to the chemicals in their work area.

29 CFR 1910.134(c):     The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:    On or about October 23, 2012:    Employees in the facility who used various chemicals while producing floc logs and other environmental products were required to wear N95 respirators for protection against dust hazards while dumping dry products.  The employer failed to develop a written respiratory protection program.

29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    On or about October 23, 2012:    Employees were operating a forklift to move products throughout the production area.  The employer did not ensure employees who received online training through a temporary agency completed practical training and were evaluated prior to being permitted to operate the forklift.
