OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a machine guarding hazard: Inside of the Can Crushing Department, employees operating the following vertical balers were not instructed in the safe work methods as described by the manufacturer: a/ Selco Baler, m/n VS-10, s/n 099765738. b/ Selco Baler, unknown m/n or s/n. Training records identifying the names of the employees and date of instruction were not maintained. One method of abatement to correct the apparent hazard is to perform monthly inspections as required by ANSI 245.5-2004, paragraph 7.1.b. DISCLAIMER: a/ The employer is not limited to the abatement method(s) suggested by OSHA. b/ The employer is resonsible for selecting and implementing an effective abatement method.
