29 CFR 1926.1053(b)(1):     Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a)  First Floor, South Exterior Wall - The top of a 8 foot portable step ladder, used by carpenters to access the second floor deck of a home under construction, was located 3 feet 3 in. below the ladder landing and was not provided with a grabrail, on or about 10/12/2012.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step:    a)  First Floor, South Exterior Wall - Workers using an 8 foot portable step ladder used the top step of the ladder while gaining access the second floor deck of a home which they were constructing, on or about 10/12/2012.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:    a)  Second Floor - A carpenter was exposed to an 11 foot fall through an 8 foot by 8 foot floor opening which was not covered or provided with any other type of fall protection.   According to the company foremen, the floor hole was open for three (3) hours before the CSHOs visit to the site.    Samuel Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(4)(i), which was contained in OSHA inspection number 313988982, citation number 1, item number 2a and was affirmed as a final order on 05/22/2011, with respect to a workplace located at 127 Mississippi Avenue, SE, Washington, D.C. 20019.
