OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard from the mechanical press die conitinuing to cycle:    a) Press Department - Provision was not made to prevent the Whitney and Jensen mechanical power press model #130, serial #A1211161, from automatically restarting upon restoration of power after a power source failure.      Among other methods, one feasible and acceptable means of abatment in an event of interruption in the electrical supply to the press would be to provide an electrical device that is designed to prevent the press from restarting automatically when power is restored, such as a magnetic restart or similiar device, as prescribed by the American National Standard Institute for Mechanical Power Presses, ANSI B11.1 - 2009, Section 6.1.5.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of a control procedure, employee training, and periodic inspections to ensure that be employee performed any servicing or maintenance on a machine or equipment where unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with CFR 1910.147(c)(4):    a) The employer did not establish, utilize an energy control procedure (lockout/tag-out program), and provide training on the energy control procedure to ensure that all required elements of the procedure were understood by employees, and that the knowledge and skills required for the safe application, usage and removal of the energy controls were acquired by employees performing servicing or maintenance on the full revolution mechanical power press, spinning machines, and punch presses.
