29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent for the following two instances; Miller Room: A milling machine operator was exposed to continuous noise at 122% dose exposure (8-hr time weighted average) or an equivalent sound level of 91.4 dBA measured over the 478 minute total sampling time as was measured on 02/05/2013. PK-10/PK-14 Blender: A PK blender operator was exposed to continuous noise at 84.4% dose exposure (8-hr time weighted average) or an equivalent sound level of 88.8 dBA measured over the 488 minute sampling time as was measured on 02/05/2013.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. Establishment: The employee(s) who perform job tasks in the milling room and who are required to wear the 3M 8511 particulate respirator, were not given the appropriate respiirator fit test prior to wearing this respirator.
