This violation was observed at the construction site on October 23, 2012 where employees were exposed to a 10 ft. 1 inch fall hazard when performing roofing work without fall protection.     SABAS GARCIA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311962260, CITATION NUMBER 1, ITEM 1 ISSUED ON MAY 01, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 18511 EGRET BAY BLVD, WEBSTER, TX 77058. FOR THIS CITATION ITEM, THE FINAL ORDER DATE WAS MAY 14, 2009 THE DATE THAT BOTH PARTIES SIGNED THE INFORMAL SETTLEMENT AGREEMENT.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level or ground.
