29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a) Private residence, front porch area: On October 23, 2012 and at times prior thereto employees performed plumbing activities in a trench that ranged from 5 and a half feet to 8 feet deep without a means of egress.     Note) Abatement certification IS required for this item.

Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Private residence, front porch area: On October 23, 2012 and at times prior thereto employees performing plumbing activities in a trench were exposed to wet, muddy excavated material and equipment that was not set back at least 2 feet from the edge of the trench. 29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift. Inspections were not made after every rainstorm or other hazard increasing occurrence:      a) Private residence, front porch area: On October 23, 2012 and at times prior thereto a competent person had not conducted an inspection as needed throughout the work shifts to determine the appropriate protective system to use prior to allowing employees to enter and perform hand digging and plumbing activities in a trench that ranged from 5.4 feet to 8 feet deep.        b) Private residence, front porch area: On October 23, 2012 and at times prior thereto a competent person had not conducted an inspection as needed throughout the work shifts to determine the appropriate protective system to use prior to allowing an employee to hand dig and work in a 4 to 7 foot horizontal tunnel at the bottom of the trench.     c) Private residence, front porch area: On October 23, 2012 and at times prior thereto a competent person had not conducted an inspection as needed throughout the work shifts to determine the appropriate protective system to use prior to allowing an employee enter both the vertical area of the trench and the horizontal area of the trench after weather conditions made the excavated walls and excavated material muddy, wet and even heavier. 29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:     a) Private residence, front porch area: On October 23, 2012 and at times prior thereto the responsible person on site allowed employees to enter and perform hand digging and plumbing repair activities in a 5 to 8 foot deep trench without any type of protective system in place.      b) Private residence, front porch area: On October 23, 2012 and at times prior thereto the responsible person on site allowed an employee to hand dig and work 4 to 7 feet horizontally into an excavated tunnel area at the bottom of an eight foot deep trench, without any type of protective system in place.      Note) Abatement certification and documentation ARE required for this item.
