OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught by hazards:    (a)  On or about 10/25/12, at the shop, Bee Welding Inc. An employee was exposed to a caught by hazard while working with a press brake (i.e. Wysong & Miles Co., 60 Tons) without point of operation guarding and/or alternate measures which provide effective protection.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder:    a.  On or about 10/25/12, at the shop, Bee Welding Inc.  Employees were exposed to a fall hazard of 8'-11" while working in an elevated storage area which was surrounded by a guardrail that lacked a midrail.

At the shop, an employee was exposed to a caught by hazard while working with a drill press (i.e. Clausing, Industrial 20) that lacked point of operation guarding.      b.  At the shop, an employee was exposed to a caught by hazard while working with a lathe (i.e. Lathe, Clausing 15") that lacked point of operation guarding.      c.  At the North building, an employee was exposed to a caught by hazard while working with a drill press (i.e. Jet Tools Model No. JDP-17MF, Stock No. 354169) that lacked point of operation guarding.
