29 CFR 1910.23(a)(3)(ii): Every hatchway and shute floor opening shall be guarded: Where operating conditions necessitate the feeding of material into any hatchway or chute opening, protection shall be provided to prevent a person from falling through the opening.    Employees working in the distribution floor were exposed to fall hazards. The employees were exposed in that over half of the 22 distribution shuts did not have safety covers to keep employees from falling in.

29 CFR 1910.272(j)(2)(ii): The employer shall immediately remove any fugitive grain dust accumulations whenever they exceed 1/8 inch (.32 cm) at priority housekeeping areas, pursuant to the housekeeping program, or shall demonstrate and assure, through the development and implementation of the housekeeping program, that equivalent protection is provided.    Employees were exposed to an environment of explosive hazards in that the housekeeping had not been maintained and allowed to exceed 1/8 inch in the Boot Pit.
