29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed at the construction site on October 23, 2012 where employees were exposed to a 19 ft. fall hazard when performing residential construction activities without fall protection system. EUCARIO CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314387903, CITATION NUMBER 1, ITEM 1 ISSUED ON MARCH 11, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 21510 ORNELLA CIRCLE, HUMBLE, TX 77338. THIS CASE WAS CLOSED ON MAY 20, 2010 Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. The employer does not ensure that ladder used by employees is extended 3 feet above the upper landing surface. This violation was observed at the construction site on August 31, 2012 where employee was exposed to a 10 foot fall hazard when using a ladder that was not extended 3 feet above the upper landing. EUCARIO CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053(b)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314387903, CITATION NUMBER 1, ITEM 2 ISSUED ON MARCH 11, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 21510 ORNELLA CIRCLE, HUMBLE, TX 77338.
