29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about October 30, 2012, and at times prior thereto, employees performing welding and grinding were exposed to continuous noise levels in excess of an 8 hour time weighted average sound level (TWA) of 85 dBA as follows: Job Description % Exposure Equivalent dBA Time Sampled a) Grinder/Helper 231.0 96.0 7 hrs 34 min b) Welder ("Wiggler") 140.4 92.4 7 hrs 54 min c) Welder ("Wiggler") 119.7 91.3 7 hrs 53 min d) Welder ("SubArc") 69.8 87.4 7 hrs 41 min Sampling was conducted during a 10-hour work shift on October 30, 2012. Zero exposure was assumed for the time period during the work shift when noise monitoring was not conducted.
