29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a) Site - On or about 10/24/12 employees were cutting bricks with the Ridgid  14 in. circular saw Model R4141, and they were not wearing eye-protective equipment.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    a) Site - On or about 10/24/12, the employer did not develop a written hazard communication program where masons were working with chemicals that included, but were not limited to, Quikrete Portland Cement Type I/II and Magnolia/Argos Custom Blended Masonry Cement Type N.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(1):  Employers did not have a material safety data sheet in the workplace for each hazardous chemical which they use: (Construction Reference: 1926.59)    a) Site - On or about 10/24/12 the employer did not have material safety data sheet for chemicals that included, but were not limited to Quikrete Portland Cement Type I/II and Magnolia/Argos Custom Blended Masonry Cement Type N, which contains silica.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
