29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use. a. On the site where mortar was mixed to install block walls, the general contractor did not ensure the guards to the top of the mortar mixer were replaced after they were removed from the back of the site to the front of the site thereby exposing employees to a caught-in hazard.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers. a. On the first floor next to the student dining section, there was a floor hole next to the main isleway which measured 32 1/2 inches by 13 inchs in size and was 13 inches deep, thereby exposing employees to a trip/fall hazard.

29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, shall be withdrawn from service until repaired. The requirement to withdraw a defective ladder from service is satisfied if the ladder is either: a. At the front of the site where the mortar silo was located, the general contractor did not ensure the fixed ladder for gaining access to the top of the silo was not damaged from being moved to the front of the site thereby exposing employees to a fall hazard.
