29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: On or about October 17, 2012 and times prior thereto, employees were exposed to thermal burns while filling LP cylinders for fueling the fork lift trucks from the bulk propane tank located in the yard of the premises.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: On or about October 17, 2012 and times prior hereto, employer failed to conduct hazard assessments to determine what if any personal protective equipment would be required to protect employees for injuries. Employer's OSHA 300 logs show several recordable hand and foot injuries to load builders and other yard workers that may have been prevented by the use of personal protective equipment.
