29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: At the workplace located at 10925 S. Rd. P, Ulysses, KS, employees exiting the guarded catwalk, to perform work activities on the mill roof including checking bins and other maintenance tasks, were exposed to fall hazards of up to approximately 20 feet from the walking surface of the roof, which was not equipped with standard railings on all open sides, to the ground/concrete below in the following instances: a) On or about August 25, 2012; an employee was using a broom and compressed air to clean the roof. b) On or about October 16, 2012; employees were cleaning out an overhead ingredient bin located on the roof in preparation to switch to a different feed ingredient. c) On or about October 23, 2012; an employee was checking an overhead ingredient bin located on the roof.

29 CFR 1910.23(a)(4): Skylight floor openings and holes were not guarded by a standard skylight screen or a fixed standard railing on all exposed sides: At the workplace located at 10925 S. Rd. P, Ulysses, KS; Employees exiting the guarded catwalk to perform work activities on the mill roof were exposed to fall hazards of approximately 20 feet through the unguarded skylight to the concrete floor below in the following instances: a) On or about October 23, 2012; an employee was checking an overhead ingredient bin located on the roof. b) On or about October 16, 2012; employees were cleaning out an overhead ingredient bin located on the roof in preparation to switch to a different feed ingredient. c) On or about August 25, 2012; an employee was using a broom and compressed air to to clean the roof.
