OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to:    a)  Southwest back corner of Carniceria Jimenez, Wheeling - The employer used a working platform that did not  meet the requirements for elevating personnel.  Employer was raising another employee on a wooden pallet from a  Nissan Powered Industrial Truck model variation #KCPH02A25PV, approximately 10 feet above the ground, without fall protection.      Among other methods, one feasible and acceptable means of abatement to correct this hazard is to conform to the American Society of Safety Engineers (ASME), Safety Standard for Low Lift and High Lift Trucks. ANSI/ITSDF B56.1-2009.
