29 CFR 1910.119(j)(4)(ii): The employer did not ensure that inspection and testing procedures follow recognized and generally accepted good engineering practices:    This condition was most recently observed at the Dallas Group America facility located in Texas City, TX, when the employer did not ensure inspection procedures used for inspecting Tank T-5C, a fiber-reinforced plastic (FRP) Tank, followed recognized and generally accepted good engineering practices. The employer failed to fully examine the extent of the damage underneath the internal liner and did not perform a proper fitness for service evaluation prior to putting the tank back in service

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices:    This condition was most recently observed at The Dallas Group America facility located in Texas City, TX, when the employer did not document that Tank T-5C complied with Recognized and Generally Accepted Good Engineering Practices after an inspection of the tank revealed that there were deficiencies in the liner, as well as a cracks in the shell of the tank.

The employer did not correct deficiencies in equipment that are outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means are taken to assure safe operation:    This condition was most recently observed at the Dallas Group America facility located in Texas City, TX, when the employer failed to correct deficiencies identified during an inspection of Tank T-5.     a)   Cracks found in the shell of Tank T-5C near the manway    b)   The liner had cracks in it and hardness test were well above the Manufacturers recommended range

29 CFR 1910.119(l)(1): The employer did not implement written procedures to manage changes (except for "replacements in kind") to process chemicals, technology, equipment, and procedures; and, changes to facilities that affect a covered process:    This condition was most recently observed at the Dallas Group America facility located in Texas City, TX, when the employer put tank T-5C back into service without implementing a Management of Change when an inspection revealed cracks in both the liner and the shell of the tank near the man way as well a liner hardness deficiencies.
