29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about October 24, 2012 and at times prior thereto, employees working on unguarded balconies were exposed to falls of approximately 10 feet to the ground below.

29 CFR 1926.1053(b)(4): A ladder was used for purposes other than the purpose for which it was designed: On or about October 24, 2012 and at times prior thereto, employees used an 8 foot step ladder to access an upper landing surface (balcony) that was approximately 10 feet above the ground. The Step ladder was used in the folded position. Employees were exposed to a fall of approximately 10 feet to the ground below.
