29 CFR 1910.178(m)(5)(iii): Powered industrial truck, with the operator dismounted and within 25 feet of the truck still in his view, did not have the controls neutralized and the brakes set to prevent movemnet: a) 4113 New Castle Ave., New Castle, DE - An employee was in the process of exiting an industrial fork truck that was not put in neutral and did not set the brake to prevent movement. This resulted in the truck rolling backward and striking a customer. The customer died as a result of the accident. This violation occurred on October 8, 2012.
