29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    The employer did not provide powered industrial truck training to employees operating a JCB Model 532, serial number SLP53200YE0776916 all-terain powered industrial truck.  Employees were exposed to struck by and falls hazards.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    At the jobsite, an employee was elevated to the roof eave by way of a wood pallet mounted on the tines of a JCB532 all terrain powered industrial truck.  The employee was exposed to a fall hazard of approximately 20 ft. from working platform to the ground and concrete below.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold  platforms unless the entire platform is attached to the forks and the fork-lift is not moved horizontally while the platform is occupied.      At the jobsite, an employee was elevated to the roof eave using a wood pallet as a working platform mounted on the forks of but not attached / secured to the power industrial truck model JCB532.  The employee was exposed to fall hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.      At 1109 SW Topeka Blvd., Topeka, Kansas employees were enganged in residential roofing on a 6 in 12 pitch roof without the use of fall protection or fall protection systems.  Employees were exposed fall hazards approximately 13 ft. from roof's eave to the ground and concrete below.

When an employee is exposed to falling objects, the employer shall have each employee wear a hard hat and shall implement one of the following measures:      On or about October 30, 2012 at 1109 SW Topeka Blvd., Topeka, Kansas. An employees working on the ground around the building was observed not wearing hard hat.  The employee was exposed to struck by hazards.
