OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards.    On or about October 29, 2012, the employer did not ensure that below the hook lifting devices, such as but not limited to, the job-made 37 foot spreader beam/lifting beam used in the pole shop was load tested, rated, marked, or inspected prior to being placed in to service. Employees were exposed to struck by and crushing hazards.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:      On or about October 29, 2012, the employer did not develop or implement written lockout/tagout procedures for each type of equipment or machine including but not limited to, the Wysong Press Brake, the Pacific Press Brake, the Plasma Cutter, Sheer Cutter, or Carlton Radial Arm Drill, located within the manufacturing facility.  Employees were exposed to electrical shock and/or amputation hazards.

Employees were exposed to electrocution and amputation hazards.

On or about October 29, 2012 and at times prior thereto, the employer did not ensure all stored or residual energy was relieved or disconntected.  The maintenance employee performing maintenance on the drill press did not isolate all energy sources prior to commencing maintenance activities.    Employees were exposed to electrocution and amputation hazards.
