29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides, The employer is failing to protect employees from potential fall hazards associated with employees working near unprotected edges with fall hazards greater than 4. This was most recently evident during the inspection of the facility located at 4041 N. 168th Street, Omaha, NE 68116, where the employer has employees replacing the filter to commercial air conditioning units without providing fall protection or requiring the use of warning lines accompanied by a written work rule for implementation; thus exposing their employees to potential fall hazards greater than 14 feet.

29 CFR 1910.26(c)(3)(i): A simple rule for setting up a ladder at the proper angle is to place the base a distance from the vertical wall equal to one-fourth the working length of the ladder. The employer is failing to protect employees from potential fall hazards associated with the improper angle set up of a portable metal ladder. This was most recently evident during the inspection of the facility located at 4041 N. 168th Street, Omaha, NE 68116, where the employer has employees using a portable aluminum extension ladder mounted by a company fabricated swivel to the top of the company van and employee will flip the ladder over and lean it against the edge of the roof, even if the angle to reach the roof is greater than the prescribed ratio of one foot out for every four feet up.

This was most recently evident during the inspection of the facility located at 4041 N. 168th Street, Omaha, NE 68116, where the employer has employees using a portable aluminum extension ladder mounted by a company fabricated swivel to the top of the company van and employee will flip the ladder over and lean it against the edge of the roof, the company has not received manufacturer approval to modify the ladders.
