29 CFR 1926.451(g)(1)(vii):  For all scaffolds not otherwise specified in paragraph through (g)(1)(vi) of this section, each employee was not protected by the use of arrest systems or guardrail systems meeting the requirements of paragraph (g)(4)section:    (a) Heiman Masonry, Inc.,@1008 Wadsworth Parkway, Westminster, CO. On or before October 11, 2012, the employer did not ensure that each employee conducting masonry activities from a tower frame scaffold was protected by the use of personal fall arrest systems or a guardrail system installed along all open sides and ends of the top working platform. This condition exposed employees to the hazard of falling a distance of 14 feet to the ground.    (b) The mason scaffold outrigger was missing the end rails. This condition exposed employees to the hazard of falling from an approximate distance of 11 feet to the ground.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:    Heiman Masonry, Inc.,@1008 Wadsworth Parkway, Westminster, CO. On or before October 11, 2012, the employer did not ensure that each employee conducting masonry activities from the tower frame scaffold was provided scaffold(s) safety training from a qualified person as required by the stardard.  This condition exposed employees to the hazard of falling a distance of 14 feet to the ground.  The training shall include the following areas as applicable:    (1) The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;    (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used;    (3) The proper use of the scaffold, and the proper handling of materials on the scaffold;    (4) The maximum intended load and the load-carrying capacities of the scaffold used; and    (5) Any other pertinent requirement of this Subpart.
