29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Construction Site: On or about October 31, 2012, and at times prior thereto, as the controlling employer, Headwaters Construction Co. Inc. did not ensure its sub-contractor, Mandala, Inc., protected their employees in that employees were exposed to a fall of approximately ten feet to the ground below while installing floor joists from the top outer plate of the wall. HEADWATERS CONSTRUCTION CO. INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311575153 CITATION NUMBER 01, ITEM NUMBER 02A AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 13, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 138 NORTH MAIN STREET, VICTOR IDAHO 83455.
