29 CFR 1926.100(a):     Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.    On or about 1 November 2012, and at times prior thereto, three employees were performing stucco work at a home under construction located at 3117 Diamondleaf Trace, Bryan, TX 77807, in which they did not use hard hats and were susceptible to work above them or to overhead objects, exposing the employees to struck by hazards from falling tools, materials, or debris.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure hard hats are utilized whenever the possibility of overhead work is present.

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.    On or about 1 November 2012, and at times prior thereto, three employees were performing stucco work at a home under construction located at 3117 Diamondleaf Trace, Bryan, TX 77807, in which they did not utilize a scaffold ladder to access the scaffold working platforms, exposing the employees to fall hazards of ~7 feet and 7 inches to the ground below.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure scaffold ladders are utilized whenever an elevated scaffold platform is more than 2 feet above the point of access from the ground.

29 CFR 1926.451(h)(1):     Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.    On or about 1 November 2012, and at times prior thereto, four employees were performing stucco work at a home under construction located at 3117 Diamondleaf Trace, Bryan, TX 77807, in which toeboards were not being utilized, exposing two employees to struck by hazards from falling tools, materials, or debris.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure toeboards are utilized whenever the possibility of overhead work is present.
