The employee was observed standing on the mid-rail to extend his reach.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) for the two employees painting the outside structure using a JLG 4 x 4 snorkeal aerial lift at the at the Channel Side Apartments, Tampa, FL, as observed on or about 10/29/2012. The employees were working in the basket and didnt have a connective device (lanyard) and not connected to the anchor point of the basket exposing them to a 38 foot fall hazard.
