29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. On or about 31 October 2012, and at times prior thereto, the employer did not conduct frequent and regular inspections of the job site located at the corner of RA Galindo Parkway and West Villa Maria Road by a competent person where the installation of a 24 inch storm pipe was being performed by a sub-contractor involving excavation of an approximately 8 foot deep trench without cave-in protection, exposing the sub-contract employees working inside the trench to caught in hazards from a cave-in. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure frequent and regular inspections of the work site are conducted for safety requirements.
