29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.    On or about 31 October 2012, two employees were working inside a trench that was not protected from cave-in with a depth of approximately 5 feet and 8 inches on one side and approximately 8 feet on the other side without the use of a ladder for egress, exposing the employees to both a fall hazard when entering or leaving the trench and a cave-in hazard.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure either a stairway, ladder, ramp, or other safe means of egress is utilized whenever a trench depth reaches 4 feet deep or more.

29 CFR 1926.651(e):     Employees were not prohibited to be underneath loads handled by lifting or digging equipment.    On or about 31 October 2012, two employees were performing grading work by hand inside a trench as an excavator was lifting and dropping dirt into the trench, exposing the employees to struck by hazards from falling rocks and clumps of dirt from the excavator bucket.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees are not underneath loads which are being lifted by equipment.

On or about 31 October 2012, two employees were working inside a trench that was more than 5 feet deep without cave-in protection that was not inspected by a competent person prior to start of work or during the work, exposing the employees to cave-in hazards.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure trenchs and excavations are inspected by a competent person prior to start of work and throughout the work shift.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).    On or about 31 October 2012, two employees were working to install a new 24 inch storm pipe inside a trench with a depth of approximately 5 feet and 8 inches on one side and approximately 8 feet on the other side without the use of cave-in protection, exposing the employees to caught in hazards from a cave-in. The trench walls were approximately 90 degrees, and one side had a single bench that was approximately 2 feet wide by 2 feet and 4 inches deep from the surface.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure protective systems are in place for employees working inside trenches that are more than 5 feet in depth.

29 CFR 1926.652(b)(2):     Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in appendices A and B to this subpart.    On or about 31 October 2012, two employees were working within a trench that had vertical walls at approximately 90 degrees, with one wall measured at approximately 5 feet and 8 inches deep, and the other at approximately 8 feet deep, without sloping and benching that meets the requirements for the soil type, exposing the employees to cave-in hazards.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure sloping and benching of the trench, or other means of cave-in protection, meet the requirements for the soil type at the work site.
