29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition:    a)The employer did not assure that the Clark GCS17 forklift (s/n G12700356792) was removed from service during a time in which it was not in safe operating condition.  Employees were exposed to injury in that the operators seat was detached from the lift and the horn was not operative.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle:    a) Forklifts were not inspected daily for conditions that adversely affect the trucks safety before being placed in service.  Employees operate forklifts daily to move materials within the warehouse and to load/unload delivery trucks.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.305(b)(1)(ii): Unused openings in boxes, cabinets, or fittings were not effectively closed:    a) The employer did not assure that an unused opening in the circuit breaker box, located in the panel used to control the forklift battery charging station, was closed to protect employees from the live parts.  Employees that accessed the cabinet to power on/off the battery charging station were exposed to electrical hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:    a) The employer did not assure that access to the electrical distribution panel(s), located in the bakery area, was maintained with at least three feet clear space.  The area in front of the electrical equipment was blocked by a battery charging station, hindering an employees ability to access the equipment.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
