29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a)Newton & Associates, LLC @ 3334 Tejon Street, Denver, CO 80211: On and before October 24th, 2012, the exposing employer did not ensure that fall protection systems were utilized by employees engaged in framing activities while working at the unprotected edges of the third level on a multi-family home. Employees were not utilizing a fall protective systems. This condition exposed employees to a fall hazard while were working at an elevation of approximately 18 feet.

29 CFR 1926.1412(g)(1): Where the severity of use/conditions is such that there is a reasonable probability of damage or excessive wear (such as loading that may have exceeded rated capacity, shock loading that may have exceeded rated capacity, prolonged exposure to a corrosive atmosphere), the employer must stop using the equipment and a qualified person must inspect the equipment for structural damage to determine if the equipment can continue to be used safely. (a)Newton & Associates, LLC @ 3334 Tejon Street, Denver, CO 80211: On and before October 24th, 2012, the exposing contractor did not ensure that an inspection was conducted by a qualified person to ensure that the Benazzato Model # U79TM self-erecting tower crane's jib was structurally sound and not damaged. The self-erecting tower crane's jib and a second crane's boom contacted during operations. The condition exposed employees to struck-by hazards as a result of the crane failing as a result of structural damage incurred after the two cranes contacted one another.
