Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a. At the construction site located at 624 Culpepper Drive in Reynoldsburg, Ohio employees were using pneumatic air guns to install roofing shingles without the use of eye protection.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. At the construction site located at 624 Culpepper Drive in Reynoldsburg, Ohio employees were performing roofing activities on a two-story residential roof without fall protection. The roof ranged from approximately 4 in 12 to 6 in 12 roof pitch, and was approximately 18 feet in height to the eve of the second story.
