29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) Jobsite - 632 Fitzwater Street - Employees working on the tubular welded frame scaffold were exposed to fall hazards of up to approximately 19.5 feet without the use of a guardrail system or personal fall arrest system.  Employees were working on the 3rd level of the scaffold on or about 10/24/12.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(e)(1):   When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.    a) Jobsite - 632 Fitzwater Street - A ladder or other safe means of access was not provided to employees working on the tubular welded frame scaffold.  Employees were using the side frames and cross bracing to access the working levels. Observed on or about 10/24/12.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.454(a):   The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Jobsite -632 Fitzwater Street - The employer did not provide each employee performing masonry operations with training to recognize the hazards and to understand the procedures to control the hazards associated with scaffolds.  Observed on or about 10/24/12.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.
