DBA ABC Block Company, was observed operating a precision lathe manufactured by Southbend Lathe, Inc. in the machine shop located at or near 6902 Brodie Lane in Little Rock, Arkansas. The employer did not require the employee to wear protective eye equipment when exposed to flying metal debris while operating the lathe.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about October 30, 2012 and times prior thereto, employees of Newoods, Inc DBA ABC Block Company performed block equipment repair on unguarded machinery in the machine shop and the block manufacturing shop located at 6902 Brodie Lane in Little Rock, Arkansas. The unguarded machinery observed is as follows: a) A 5-speed heavy duty drill press manufactured by Sunex (model 5B-5) was observed in the block manufacturing shop. The drill press was not guarded at the point of operation to protect the operator from flying metal debris or rotating parts. b) A 5-speed heavy duty drill press manufactured by Village (serial#: 052190) was observed in the machine shop. The drill press was not guarded at the point of operation to protect the operator flying metal debris and rotating parts. c) A vertical milling machine manufactured by Bridgeport (serial#: J-157304) was observed in the machine shop. The milling machine was not guarded at the point of operation to protect the operator from flying metal debris and rotating parts. d) A vertical milling machine manufactured by Bridgeport (serial#: J-81795) was observed in the machine shop. The milling machine was not guarded at the point of operation to protect the operator flying metal debris and rotating parts. e) A precision lathe manufactured by Southbend Lathe, Inc. was observed on the North wall of the machine shop. The lathe was not guarded at the point of operation to protect the operator from flying metal debris and rotating parts.
