29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a. Waffle House, Hwy 11 at Hwy 49, Hattiesburg MS - On or about October 31, 2012 employees were observed working from a 12 feet high welded frame scaffold without having a ladder or other forms of safe access to the platform.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    a. Waffle House, Hwy 11 at Hwy 49, Hattiesburg MS - On or about October 31, 2012 an employee was observed working from a scaffold platform that was 12 feet above a concrete pad.  Guardrails or a personal fall arrest system were not used to prevent the employee from falling and striking the concrete pad.

29 CFR 1926.452(c)(2):     Frames and panels shall be braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally. The cross braces shall be of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections shall be secured.      a. Waffle House, Hwy 49 at Hwy 11, Hattiesburg MS - On or about October 31, 2012 employees were observed working from a 12 feet high welded frame scaffold that did not have cross bracing on the backside. A smaller unoccupied scaffold was missing cross bracing on the front side of the scaffold.
