29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    A. Ivan Ramirez worksite located at 2055 South Ave., Toledo, Ohio: On or about November 6, 2012, the employer did not ensure an employee was wearing proper eye protection while operating a pneumatic nail gun when performing weatherproofing activities on the two story residential structure. The employee was exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    A. Ivan Ramirez worksite located at 2055 South Ave., Toledo, Ohio: On or about November 6, 2012, the employer did not ensure employees were protected from falls while performing weatherproofing activities on the two story residential structure. The employees were exposed to a fall distance of approximately 20.00 feet to the lowest level.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     A. Ivan Ramirez worksite located at 2055 South Ave., Toledo, Ohio: On or about November 6, 2012, the employer did not ensure the side rails of the extension ladder was extended at least three feet above the landing surface. Three employees were exposed to falls while using the ladder to access the scaffold and roof.
