OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were allowed to have direct contact with apex predators such as Syrian Brown/Grizzly cross during sanitation activities. (a) Bear Enclosure: On or about November 4, 2012, and at times prior thereto, employees were exposed to potential attacks from captive bears while performing activities including but not limited to sanitation of the enclosure.

29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident: (a) On or about 4 November 2012, the employer failed to report to OSHA a work-related death that occurred in the bear enclosure at the Animals of Montana, Inc. at 170 Nixon Peak Rd, Bozeman, Montana.
