29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about November 7, 2012, and times prior thereto, at the Duncan Donuts new-construction jobsite, the employer failed to ensure that a 24-ft. portable fiberglass ladder side rails were extended at least three feet above a flat-roof platform, exposing subcontractors employees to fall hazards of 14.5 ft. ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about November 7, 2012, and times prior thereto, at the Duncan Donuts new-construction jobsite, the employer failed to ensure that a drywall contractor worker was fall protected while at an unprotected edge on a flat roof, exposing employee to fall hazards of 14.5 ft. Employer was previously cited for a similar violation of a different standard [29 CFR 1926.451(g)(4)(i)],which was contained in OSHA inspection number 314097270, citation number 01, item number 01 and was affirmed at an Informal Settlement Agreement on July 16, 2012 regarding a workplace located at 6740 Waters Street., Savannah, GA 31406. ABATEMENT CERTIFICATION IS NOT REQUIRED.
