29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a. At the site, employees were exposed to a fall hazard 12 feet to the ground below when using a Genie S-40 aerial lift during metal framing operations. A fall arrest system such as a full body harness or a body belt used as a restraint system was not used by employees in the basket of the aerial lift.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. At the site, employees were not protected from falling to the ground while installing metal framing. An employee was exposed to a fall hazard 12 feet high while standing on a piece of plywood placed between the rafters wile installing metal framing at the entrance of the building.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards as required by paragraph (a)(1)-(5) of this section:    a. At the site, employees were installing metal framing at the entrance of the building using an aerial lift (elevated scaffold platform). Employees involved in using aerial platforms were not provided training and education in the following:    1. The nature of fall hazards and any falling object hazards.    2. The correct procedures for dealing with erecting, maintaining, and disassembling the fall protection system and falling object protection system being used.    3. The proper use of the scaffold, and the proper handling of material on the scaffold.    4. The maximum intended load and load carrying capacities of the scaffold.    5. Any other pertinent requirements of Subpart "L" (Scaffolds) under 29 CFR 1926.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a. At the site, employees working at the entrance of the building installing metal framing were exposed to a 12 foot fall hazard and were not provided training and education relating to fall protection, hazard recognition, procedures to be followed to minimize these hazards and the proper use and limitation of fall protection equipment and fall protection systems. The employer did not train employees to inspect their fall protection equipment in order to assure that equipment is in good condition and are functioning properly.
