29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.     On or about November 5, 2012, an employee was exposed to fall hazards of up to 13 feet when there was no ladder to access the second level of the scaffold.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).    On or about November 5, 2012, an employee was exposed to fall hazards of approximately 13 feet when the top level of the scaffold and the outrigger were not equipped with guardrails on the side or ends of the scaffold.
